I. Call to order at 7:04 p.m. II. Public present: Dan Seamon III. Minutes of 11/27/06 (Donahey/Troup) approved as amended, Article VII to Article VIII and REINCIPAL to PRINCIPAL IV. New Business A. Case #48-06 A request by Emmet County Planning Commission to change Article VIII, Section 801, paragraphs 2 & 7 of the Emmet County Zoning Ordinance. Motion to recommend the revision of Article VIII, Section 801, Principal Uses Permitted Subject to Special Zoning Conditions: Remove Paragraph 2 and renumber remaining paragraphs in Section 801. Paragraph 7. Remove “sawmills,” and change “without a permit” to read “with a permit.” (Simon/Gelb) Unanimous in favor. Motion to revise Section 800, Paragraph 7 to remove the words “golf courses” as a principal use in order to provide oversight that would protect the health, safety and welfare of the community, and natural resources. (Simon/Donahey) Unanimous in favor. B. Case #10A-06 – zoning Ordinance Text Changes (note: earlier incorrectly identified as 10-06). Motion to recommend the proposed text changes with the following exceptions: 1) Section 2400, 2nd sentence replacement to read: “… such plans have been inspected by the Zoning Administrator or Assistant Zoning Administrator.” 2) Section 2401, introductory paragraph and paragraphs 1 & 2: No change, i.e. leave in the words “drawn to scale.” 3) Section 2401, paragraph 4, change addition to read: “…, including, put not limited to a certified survey.” Note: This change is proposed in order to allow applicants to submit an accurate drawing that is not certified. 4) Section 2405, paragraph 4, introductory paragraph to read: “The Planning Commission shall consider whether the following standards have been addressed to promote public health, safety and welfare, and carry out the spirit and intent of the Ordinance.” Note: the phrase “protect land values” is ambiguous, open to too much interpretation, unclear as to whose land values are meant (e.g. community’s, applicant’s, neighbors’, future generations’, etc.) (Gelb/Troup) Unanimous in favor.
V. Old Business A. Stormwater Ordinance–Commission members should read this (it was distributed previously). Simon will see if Nancy Solar can come to our January meeting. VI. Report of Trustee – nothing to report VII. Public Comments – none VIII. As requested 2 copies of the Zoning Ordinance were purchased and have been left in the closet for public use. IX.
