I. Call to order at 7:00 p.m. II. Public present: - Dan Seaman III. Minutes of 01/23/06 approved as written (Kurburski/Gelb) IV. New Business A. Case #3-06 – A request by Steven Frisbie for a front yard setback variance of up to 33’ from a private road easement on property located at 1120 South Lamkin Drive. The property is zoned RR-2 Recreational Residential and is tax parcel number 24-06-11-12-100-027. The request is to allow a 12’ x 12’ shed / accessory building within 7’ of the private road easement which accesses five parcels. We looked at Section 2504 (3) of the EC Zoning Ordinance. Examining (a) (b) (c) & (d) It doesn’t appear to be a hardship. Several members had looked at the property and there are other places the shed could be placed outside the setbacks and without cutting trees. We do not wish to set up a situation where we allowed a building that will be in the way should they decide to widen the road. The shed as proposed is totally in the setback area. Kurburski moved/Gelb seconded to recommend denial with these comments. Motion carried unanimously. a) There are no exceptional circumstances b) Variance is not necessary for the preservation and enjoyment of substantial property rights c) Could be detrimental to public welfare should a wider “common driveway” be needed in the future d) There are appropriate sites for this building elsewhere on the property that do not require a variance. 1) north of the house 2) in the SW corner of the driveway pad. V. Old Business - none VI. Other Matters A. Informational survey / mailing (status: approved by Board, CD ready to produce, DMS asked county for mailing labels.) B. Zoning Clinic on March 22., 4:00 to 6:00 at County Building C. Master Plan—we looked at all the items that had received more than one vote. Two were decided on as our current focus: Finish plan for Stutsmanville; Twp. zoning. On the horizon: identify large contiguous tracts and look at ways of preserving them (TDR/PDR, etc.). Will review the STDI plans for Stutsmanville at the next meeting. Please review beforehand. D. True North Golf Club – monitoring status unknown. Simon contacted Tammy at ECP. Tammy sent letter stating that requirements run with the property and if testing is not verified soon the next level of enforcement will be required. VII.
