I. Call to order at 7:00 p.m. by Vice Chair Trufant II. Public present: Dan Seamon, Elaine Keiser (architect for Reids), Becky & Marty MacGregor III. Minutes of previous meeting of March 24, 2008 approved as presented. IV. New Business: Case#:20B-98 Becky MacGregor request for a Site Plan Review Amendment to expand a dog kennel operation on a 40-acre property at 4300 Five Mile Crk Rd. They have a request to build a new kennel building. The Special Use permit for a kennel was approved per section 2102-9 of the Zoning Ordinance in 1998. The kennel expansion is per Section 2405 on the Zoning Ordinance. The property is zoned FF2 Farm Forest. Questions were directed to the MacGregors regarding the new building. It is an enclosed exercise area and additional kennels. They currently have 8 kennels this will add 25 more. The building is straight forward and the special use permit already approved. Drawings appear to be in order. Motion to approve the request (Kurburski/Gelb) was approved unanimously. Case # 9A-03 The Reid property at 186 S Lakeshore Dr. for a front yard setback variance to build a house and future garage which is partially in the Road Right of Way setback. The property is zoned SR2. The setback from the road right of way is 40’. The Reids are proposing 21’. Elaine Keiser, architect for the Reids spoke to the plan. We reviewed it and asked several questions about items that were written on the blueprint about a shop and that it wasn’t surveyed, etc. These items seemed in error and the architect agreed that they were and we crossed them out. She initialed it. After a great deal of discussion and one comment against from D. Seamon the only public in attendance at this part of the meeting a motion was made by Gelb and seconded by Kurburski.
Approve a variance for the house and garage with the stipulation that the garage should not encroach into the setback any more than the house currently does on the prints dated 8/1/07. This appears to be approx. 5 or 6 feet. Unanimous.****
Case #8-08 A request by ECPC to amend the text of Article XXII Section 2207 for indents and definitions and text amendments for Signs and Billboards. They want negative or positive response. This was a huge packet of paper that the PC members only tonight received from Bo. Motion (Donahey, Gelb) that the time frame was such that we couldn’t fully investigate and respond in a timely fashion. Passed unanimous. VII. Old Business: None VI. Report of Trustee: Not present VII. Public comment: None VIII. ****An amendment was offered to the Reid motion to clarify our reasoning. (Gelb & Kurburski). The following passed unanimously. This is the full motion. Given the constraints of the lot for the Reid Case #9A-03 we feel that some leeway should be given lest it prove too much of a hardship to build this home. However, we also feel the steep slope ordinance must be maintained and we wish to see the least possible encroachment on the front setback. Therefore we approve a variance for the house and garage with the stipulation that the garage should not encroach into the setback any more than the house currently does on the prints dated 8/1/07. This appears to be approx. 5 or 6 feet.
