FRIENDSHIP TOWNSHIP PUBLIC HEARING AND BOARD MEETING MONDAY, APRIL 5, 2004 @ 7:00 P.M. @ Friendship Township Hall
Meeting called to order at 7:00 p.m. by Supervisor Scott. Agenda approved with additions. Minutes of March meeting approved as presented. Treasurer’s report received.
Van Divner moved, Donahey seconded, PASSED, to approve the proposed 2004-05 Budget for presentation at Public Hearing. (5-0)
PUBLIC HEARING: 7:25 p.m. to 7:53 p.m.
Scott moved, Mottl seconded, PASSED, to adopt proposed 2004-05 Budget Expenditures as follows: General Fund $150,193; Recreation Fund $3,500; Capital Outlay $67,000, and appropriate funds for same. Roll call vote as follows: Mottl - yes; Ward - yes; Donahey - yes; Van Divner - yes; Scott - yes.
Ward moved, Van Divner seconded, PASSED, to continue using Bankone as township’s financial institution. (5-0)
Van Divner moved, Ward seconded, PASSED, to hold board meetings on the first Monday of each month at 7:00 p.m., except for July, which will be held on Wednesday, July 7, and September, which will be held on Wednesday, September 1. Planning Commission meetings will be held on the 4th Monday of each month at 7:00 p.m. as needed. Election Commission meetings will be held in conjunction with the July and October board meetings. (5-0)
Van Divner moved, Ward seconded, PASSED, to levy 1.0 mill in 2004, as rolled back, for township operations. (5-0)
Van Divner moved, Scott seconded, PASSED, to retain Richard Mahlmeister, CPA, to perform the township audit. (5-0)
Scott moved, Donahey seconded, PASSED, to recommend to the Emmet County Planning Commission concerning Case # 22A-95 Craig Cottrill that the County Planning Commission table the application and send it back to the Township for further consideration because the Township does not believe that compliance with the standards in Sections 2100(Special Approval Use and Conditional Use Review Standards) and 2405(4) (Site Plan Review Standards) can be demonstrated without the following information and considerations: Response to deficiencies noted in the TMWC Review of Application for Zoning Action, Site Plans, and Hydrogeological Investigation Report for a proposed Seven Mile Point Ridges II Development, Section 30, T.36N., R.6W., Friendship Twp, Emmet Co., Michigan. Specifically the Executive Summary which states “The applicant’s request for site plan approval from the Emmet County Planning Commission is administratively incomplete, precluding review as proposed because it: · Does not demonstrate compliance with the Friendship Township Master Plan. · Does not demonstrate compliance with the Emmet County Comprehensive Plan, especially regarding the applicant’s requirement to find and record adequate data and to insure compatibility with the natural environment, protect environmentally sensitive features, and the required consistency with approved Friendship Township Master Plan. · The application as proposed fails to demonstrate compliance with Special Land Use criteria (see Section 3.1 of this report), Site Review standards (see Section 3.2 of this report) and additional zoning requirements, as detailed in Section 3.3 of this report.. · Would violate Emmet County’s Zoning Ord. by failing to undertake a natural features inventory as required by Section 2405(2)(h) , and/or submit an adequate impact assessment as required by Section 2102(14). · The applicant has failed to conduct and/or submit an adequate hydrogeological study as required by Section 2102(14). · The applicant has failed to provide an adequate impact statement as required by Section 2405(3).
Friendship Township Minutes - page 2 · The applicant has failed to provide, or complete, an inventory of environmentally sensitive areas and natural features (including but not limited to fragile slopes, wetlands, if any, etc.) as required by Sections 2102(14) and 2405(2)(f) and (h). · The applicant has failed to provide, or complete detailed slope and soils analyses as required by Section 2405(2)(g). · The applicant has failed to provide sufficient detail on proposed grading and soil erosion control plans as required by Emmet County Zoning Article VII, Section 702. · The applicant has failed to provide detail to demonstrate compliance with bank, slope and hillside stabilization (i.e. grading, slope/sedimentation control plans) along South Lake Shore and Lower Shore Drives, also as required by Emmet Count Zoning Article VII, Section 702. · The applicant has failed to propose an entrance with safe sight distance and grade, as required by Sections 2100(6) and (7). · The applicant has failed to provide sign and lighting plans as required by Section 2405(2)(d).” And because the applicant does not demonstrate that the project will meet the requirements within:
a. Section 2100 (3) concerning “impact of the proposed use on the quality and quantity of water resources, domestic water supplies and capacity to absorb the anticipated sewage disposal demand”, and Section 2100 (2) concerning the projects ability to “accommodate the use, its future expansion, customary accessory uses and on site services (sewage disposal and water supply)”. A Health Department assessment of the proposal and an adequate hydrogeological study is necessary.
b. Section 2405 (4) (g) concerning “Spaces, right-of-ways, easements, and related site plan elements needed to serve the proposed use or development for such services as fire protection,……..”. Approval by the Readmond Friendship Cross Village Fire Fighters of an easement for at least one underground fire hydrant is necessary to satisfy this requirement. Also, Section 2102(14)(b)(1) which states that “all vehicle accessways shall provide sufficient side and overhead clearance to accommodate fire fighting equipment,……..”.
c. Sections 2102 (14), 2405 (2)(h), and 2405 (3)(c) concerning impact on natural features. A Natural Features Inventory is necessary to meet these requirements that will recognize that this is a unique piece of property between two scenic roads and also one of the largest undivided properties in Friendship Township. The inventory must also assess threatened and endangered plants and animals.
d. Section 2102(14)(c) which states that “All plans subject to review as described in the “Land Development Standards” paragraph must have road plans prepared and sealed by a Michigan registered professional engineer”. Road grading plan details are necessary to show impact on topography along M-119 and Lower Shore Drive and within the project.
The application is also lacking the following:
* Documents showing MDOT review, comments, and permit for access from M-119 and same from EC Road Commission for access from Lower Shore Drive.
* A Master Deed and Association By-laws that will delineate, among other things, a) dedication of open space; b) outdoor lighting policies; c) tree trimming and yard size policies; d) shared driveways; etc.
We would also like to continue to work with the developer in considering 50% open space as per the Friendship Twp Master Plan, a phasing plan for the development, more buffer on the M-119 lots, M-119 and Angell Farm viewshed protection, and the possibility of shared driveways on Lower Shore Drive. The Board requests that the Emmet County Road Commission place gravel as needed on Middle Village Drive east of West Townline to Kurburski’s driveway.
Scott moved, Ward seconded, PASSED, to appoint Denise Simon and Doug Sundmacher to the Friendship Township Planning Commission for 3 year terms beginning October 2003, and Jenifer Gelb to fulfill Carolyn Hughes term which ends September 30, 2005. (5-0)
Scott to seek additional quotes for Water Test Program.
Spring Clean up- In order to help stem escalating costs, lumber and tires will not be picked up this year. Clean up will be May 10-14. Mottl will serve as information resource that week.
Van Divner moved, Scott seconded, PASSED, to use Beckman Services for dust control application. The 28% mineral brine will be used for the first and second applications, then the 14% as needed for the rest of the season. The brine is not to be applied within 150 feet of Five Mile Creek on Geary Road. (5-0)
Donahey moved, Scott seconded, PASSED, to adopt Township Resolution 2004-01, WATER RELOCATION RESOLUTION. Roll call: Mottl - yes; Donahey - yes; Van Divner - yes; Ward - yes; Scott - yes.
Mottl reviewed checks and bills for accuracy.
Van Divner moved, Ward seconded, PASSED, to approve payment of the bills. Checks # 4655 - 4677 in the amount of $6,595.16 were written. (5-0)
