Regular Little Traverse Township board meeting convened on Wednesday, July 8, 2009 at 4:00 P.M.

 

Pledge of Allegiance was recited.

 

Roll Call: Board members present Lynda Arman, Clerk, Bill Dohm, Supervisor, Connie O’Neill, Treasurer, Ken Garver, Trustee, Wayne Allerding, Trustee. Also present Jane Taylor and several guests (attached list).

 

Distribution of Correspondence: Financial Statements: Minutes of ECRC of May 29 & June 12, & 26, 2009: Notice of Group Meeting with ECRC relative to ORV routes for July 28, 2009: Minutes of HSASDA of June 11, 2009: Notice of Agenda of Emmet County Chapter MTA meeting scheduled for July 15, 2009: Par-Plan Newsletter: Letter from Pleasantview Township regarding Allied Ambulance: 2nd Qtr. Water flow report.

 

Supervisor and board members discussed and reviewed the correspondence, in particular the meeting to be held regarding ORV discussion with Emmet County Road Commission.

Letter from Pleasantview Township regarding Allied Ambulance was discussed. Consensus of board members was to not be involved in the matter.

 

Approval of Minutes:  Minutes of June 10, 2009 was corrected as to North View Trail Assessment District. Upon corrections of the minutes motion by O’Neill, supported by Allerding and carried board approved the minutes of June 10, 2009.

 

Public Comment: Board members heard support from the Public for County adoption of the ORV Ordinance. Meeting dates and times were also discussed. Consensus of the board members was generally in support of the ordinance. Board also discussed some of the roads to be closed to ORV use in the Township.

 

North View Trail Special Assessment District No. 1:          The supervisor stated that the next order of business was the consideration of the paving and improvement plans for North View Trail, a private road in Section 9, the location thereof, an estimate of the costs of the project, the special assessment district proposed to be created for the recovery of such costs, and the petitions for the same.

 

The supervisor reported that a public hearing was duly conducted on these matters on June 10, 2009, and that no objections were filed.  Questions were asked concerning the project, but no written objections were submitted with respect to any of the foregoing.  The Board had ordered construction bids to be submitted to support the engineers cost estimates. 

 

The supervisor submitted construction bid results tabulated by Benchmark Engineering recommending the low bidder, Tri-County Excavating in the amount of $38,145.80 be considered.  The engineers estimate of staking, oversight, and density control is $2,000. to $4,000.   Additionally, legal council and required publication and notice costs will exceed $1,000.

 

After some further discussion, the following preamble and resolution were, upon motion, submitted by C. O’Neill and supported by K. Garver for adoption:

 RESOLUTION ON NORTH VIEW TRAIL SPECIAL ASSESSMENT DISTRICT NO 1. 

WHEREAS,  the township board of the Township of Little Traverse received petitions signed by more than 50 percent of the total land area and road frontage of the proposed special assessment district described hereinafter, and accordingly, determined to proceed under the provisions of PA 188 of 1954, as amended, to secure plans and estimates of cost together with a proposed special assessment district for assessing the costs of the proposed paving and improvement to schedule a public hearing upon the same for June 10, 2009 commencing at 4:00 o’clock p.m., and

 

WHEREAS, the plans, estimates of cost and proposed special assessment district were filed with the township clerk for public examination and notice of the within hearing upon the same was published and mailed in accordance with the law and statute provided as shown by affidavits pertaining thereto on file with the township clerk, and

 

WHEREAS,  in accordance with the aforesaid notices, a hearing was held on June 10, 2009 commending at 4:00 o’clock p.m. and all persons given the opportunity to be heard in the matter, and

 

WHEREAS,  as a result of the foregoing, the township board believes the project to be in the best interests of the township and of the district proposed to be established therefore;

 

NOW, THEREFORE, BE IT HEREBY RESOLVED as follows:

 

1.                  That this township board does hereby determine that the petitions for the North View Trail Special Assessment District No. 1: were property signed by the record owners of land whose area constitutes more than 50 percent of the total area and road frontage upon the proposed improvement.

 

2.                  That this township board does hereby approve the plans for the North View Trail Special Assessment District No. 1: as prepared and presented by the township’s registered engineer and his estimate of costs along with his recommended bid for the completion thereof of $ 42,145.80, say $42,000.

 

3.                  That the North View Acres Condo Grounds (parcel 24-08-16-09-226-001) are not separately assessed for tax purposes.

 

4.                  That this township board does hereby find that each remaining parcel of land to be specially assessed is one qualified zoning lot as defined in the Little Traverse Township Zoning Ordinance.

 

5.                  That the parcels of land to be assessed should be assessed on a per lot basis, as there is a special benefit to each of the assessed parcels, and the cost to each parcel on this basis is reasonably proportionate to the value that the improvement will provide to each  parcel.

 

6.         That this township board does hereby create, determine and define as a special assessment district to be known as North View Trail Special Assessment District No. 1: within which the costs of such improvements shall be assessed according to benefits, the following described area within said township which shall include the lands and premises more particularly described as follows:

7.         That on the basis of the foregoing, this township board does hereby direct the supervisor and assessing officer to make a special assessment roll in which shall be entered and described all the parcels of land to be assessed with the names of the respective owners thereof if known, and a total amount to be assessed against each parcel of land which amount shall be the relative portion of the whole sum to be levied against the parcels of land in the special assessment district as the benefit to the parcel of land bears to the total benefit to all the parcels of land in the special assessment district.  When the same has been completed, the supervisor or assessing officer shall affix thereto his certificate stating that it was made pursuant to this resolution and that in making such assessment roll, he has, according to his best judgment, conformed in all respects to the directions contained in this resolution and the applicable state statutes.

 

8.            That all resolutions and parts of resolutions insofar as they conflict with the         provisions of the within resolutions be and the same are hereby rescinded.

  

Upon roll call vote as follows:  Allerding yea, Arman yea, Dohm yea,

 

                                                 Garver yea, O’Neill yea

 

The supervisor declared the motion carried and the resolution duly adopted.           

 

The supervisor then reported that he, in anticipation of the foregoing resolution, had completed the assessment roll in accordance therewith and had attached thereto his certificate as required by said resolution.  The assessment roll was then received and filed with the office of the township clerk.

 

The following preamble and resolution were then submitted upon motion of C. O’Neill and supported by K. Garver for adoption:

  RESOLUTION SCHEDULING HEARING ON ASSESSMENT ROLL FOR NORTH VIEW TRAIL SPECIAL ASSESSMENT DISTRICT NO. 1. 

WHEREAS,  the supervisor and assessing officer of the township has, in accordance with resolution of the township board and the laws and statues pertinent thereto, prepared a special assessment roll in the total amount of $ 42,000 covering all the assessed parcels of land in the North View Trail Special Assessment District No. 1, according to the relation of the benefit to each parcel of land to the total benefit to all parcels of land in such special assessment district and has affixed thereto his certificate as required by said resolution.

 

NOW THEREFORE, BE IT HEREBY  RESOLVED as follows:

 

1.                  That said special assessment roll shall be filed with the township clerk and shall be available for public examination during regular working hours of regular working days from the present date until the public hearing upon the same and shall further be examined at such public hearing.

 

2.                  That the township board shall meet at 4:00 o’clock p.m. on August 12, 2009 at the Township hall located at 8288 S. Pleasantview Road, Harbor Springs, Michigan 49740, within the township, to review such special assessment roll and hear any objections thereto.

 

3.                  That the township clerk shall cause notice of such hearing and the filing of such assessment roll to be published twice in the Harbor Light, a newspaper of general circulation in the township prior to the date of the hearing with the first publication being not less than 10 days prior to the hearing and shall further cause notice of such hearing to be mailed by first-class mail to all owners of or persons interested in property within the North View Trail Special Assessment District No. 1 as shown on the current assessment roll of the township also at least ten (10) days prior to said hearing, all in accordance with law and statute provide.

 

4.                  All resolutions and parts of resolutions insofar as they conflict with the provisions of the within resolution are hereby rescinded.

The supervisor declared the motion carried and the resolution was duly adopted.

Report on HS District Library:  Supervisor reviewed with board members regarding the Harbor Springs District Library. No action was taken on the matter.

 

Township Improvement Projects:  Cabinets in the board room have been installed. Light Pole in the parking lot is in progress. Remodeling of office in the hall will start soon. It was also discussed as to what to do with very old law books that have been stored in the soon to be office space, upon discussion it was in the best interest to dispose of them rather than continue storing them. Road projects were also discussed. Most will be completed soon. No other discussion was made.

 

Proclamation Resolution: The Township recognizes the dedication and hard work required for a Boy Scout to earn the Eagle Rank. Motion by O’Neill supported by Allerding and carried a Proclamation Resolution was made to acknowledge Kole Slabaugh for his contribution to scouting and to his community for his accomplishments.

Compression Brake Complaint: Board discussed the Compression (Jake) brake complaint on US 31. It was requested more information on regulatory options before pursuing the matter.  No action taken at this time.

 

Spring Lake Mowing:  Mowing of Spring Lake trail to Oden Trail was discussed. Township would share the cost with Littlefield Township and Bear Creek Township. Consensus of the board was to have the mowing done.

 

Harbor Springs Airport: Supervisor reviewed with the board the status of the new airport terminal progress. The cost and funding of the Airport was reviewed. Bids would be put out and funding costs over the grant would be sought.

 

Approval of Bills: Upon review of the voucher for payment of the bills, motion by Allerding supported by Garver and carried board approved payment of the following bills: General Fund $32,535.45: Sewer Fund $22,374.55: Water Fund $7,963.48. Reference to breakdown attached herein.

 

No other business was brought before the board.

 

Being of no further business brought before the board, Supervisor Dohm adjourned the meeting at 5:15 P.M.
