Little Traverse Township Zoning Board Regular Meeting July 2, 2007 7:30 P.M.
Chairman Joe Chattaway called the meeting to order at 7:30 P.M. Roll call:

Also present were Bill Dohm, Randy Frykberg, Jane Taylor, Albert Lee, Jill and Greg Nuding and Amelia Nicolson.
Approve the agenda:
The chairman heard no objection to the agenda as presented.
Case # B-6-2007:
Conduct a Public Hearing on a proposed amendment to add Article X-B PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT (PUD) and related definitions to the Township Zoning Ordinance.
The Board reviewed the changes they had requested last month- see attached draft ordinance. They had more concerns and requested a few more changes.
The Public Hearing was opened.
There was no comment from the public.
The Public Hearing closed.
Jean Beckley motioned to defer any decision to the next meeting, to allow time for the corrections to be made and reviewed. Van Berlo supported the motion. Roll call vote: Beckley, yes; Shepherd, yes; Van Berlo, yes; Johnson, yes; Chattaway, yes. Motion carried. Case # B-5-2007:
Site Plan Review for an addition to the Little Traverse Bay Humane Society operation at 1300 W. Conway Rd.
Randy Frykberg reviewed the case saying the Little Traverse Humane Society has requested permission to build a 40’X50’ addition on the east side of their existing 100’X50’ building at 1300 W. Conway Rd and to add a 30’X16’ pad in the rear of the property for kennels. The building addition will be for grooming and boarding animals.
The property is 2.9 acres, consisting of 3 parcels, is zoned I-1 Light Industrial for the front two parcels and I-2 General Industrial for the rear parcel. Kennels are an allowed use in the I-1 and I-2 Districts. Minimum building setbacks will be 50’ from the west property line, 299’ from the front property line, 140’ from the east line and 224’ from the rear line. Required setbacks are greatly exceeded. Including the proposed addition, all buildings and accessory structures will cover 6.4% of the property. The Humane Society is served by a community well and by the Township Sewer system. 14 parking spaces exist (including 2 barrier free) and these spaces will be increased to meet the standard of 10’X 20’. The driveway to the lot, landscaping, snow storage/management, etc. will not be altered by this addition. The original site plan for the existing building was approved in June, 2000 with the condition that the animals need to be within the building from 10 PM to 8AM.
Greg Nuding, builder for the project, told the Board the addition was for grooming and the new kennels would be used to contain the dogs until their owners picked them up later in the day.
John Johnson was very concerned with additional dogs and the barking. He felt the board should have the ability to review the situation after it is up and running and resolve any issues regarding noise.
Johnson motioned to approve the Site Plan for an addition to the Little Traverse Humane Society building at 1300 W. Conway Rd., parcel # 24-08-16-14-335-001, 335-002 and 300-013) as presented. The Township reserves the right to review and resolve any noise issue after the building is completed and in use. Motion support came from Marty Van Berlo. Roll call vote: Beckley, yes; Shepherd, yes; Van Berlo, yes; Johnson, yes; Chattaway, yes. Motion carried. Case #B-7-2007
Site Plan Review for Albert Lee to construct and operate a building trades storage and office building at 965 W. Conway Rd (access off Mink Rd.)
Randy Frykberg reviewed the case. Albert Lee has requested permission to construct a 40’X80’ building trades storage building with a connected 18’X30’ office building on part of Lot 7, Plat of Moonglow Trail.
He said the 20,000sq.ft. parcel ( 130’X154’) is zoned B-2 General Business and office buildings and enclosed storage are uses allowed by right in the B-2 district. The proposed building would cover approximately 19% of the parcel. 7 parking spaces are proposed. A screened dumpster on a concrete pad is proposed for the northeast side of the storage building. The north side of this parcel abuts a FF-1 Zoning District and a screen of 4’ tall evergreens is proposed. No landscaping is shown for the front but there are some trees presently there. Snow storage areas are shown on the plan and storm-water will be handled by 2 retention/detention ponds on site. New on-site well and septic will be constructed per Health Department requirements. Setbacks for the district are met.
Jean Beckley questioned the safety of a drive on Mink Road.
John Johnson was concerned with so much impervious areas and was told by Randy Frykberg that it is designed to handle the 50 year storm.
Al Lee said there are 6 employees coming and going and deliveries could be 2 or 3 trucks a month- small trucks, not semis. He said the proposed building will be for the Seamless Gutter portion of the business and all storage would be inside. He noted the internal drive to make it easier and safer for deliveries and other traffic.
Bill Dohm presented pictures of the site that showed the staked driveway entrance and also the existing drive servicing the businesses across the street.
Beckley motioned to approve the site plan for a new commercial building , parcel # 24-08-16-15-276-007, for Albert Lee as presented. It meets all the criteria for zoning.Motion support came from Ed Shepherd. Roll call vote: Beckley, yes; Shepherd, yes; Van Berlo, yes; Johnson, yes; Chattaway, yes. Motion carried.
