Little Traverse Township Zoning Board August 6, 2007 7:30 P.M. Township Hall Chairman Joe Chattaway called the meeting to order.
Roll call:
Jean Beckley, absent Joe Chattaway, present John Johnson, present
Ed Shepherd, present Marty Van Berlo, present
Also present: Bill Dohm, Randy Frykberg, and Jane Taylor.
Minutes: A motion was offered by Shepherd to approve the minutes of July 2, 2007 as presented. Support came from Van Berlo. Approved by voice vote. Agenda:
There was no objection to the agenda as presented.
Case # B-6-2007:
Evaluate results of public hearing on a proposed amendment to add Article X-B PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT (PUD) to the Twp. Zoning Ordinance and make recommendation to Twp. Board.
Randy Frykberg told the Board the PUD Conditional Use Overlay District, as presented, will encourage site design in a manner which seeks to integrate new structures and uses with natural site characteristics to minimize impacts on the site and adjoining properties while enhancing the total project design with planned open space. The regulations are intended to provide for a controlled mix of compatible land use types, and a more desirable environment by retaining the rural and natural character of the township through the preservation of open spaces, woodlands, streams, water frontage, hill, and similar assets. The PUD regulations require an overall property use plan to not only help protect natural features, but to also encourage efficiency with respect to land use, natural resources, energy, roads, pedestrian-ways, public services and utilities.
John Johnson questioned the benefit to the land owner and was told the land own would have a more efficient development with less costs for utilities, paving, etc. and more flexibility for the land use. A PUD doesn’t require a rezoning (a rezoning would require setbacks lot by lot) and would allow the property to be more compatible with the
neighborhood. Van Berlo motioned to recommend approval to the Township Board to add Article X-B Planned Unit Development Overlay District (PUD) to the Township Zoning Ordinance as presented. It makes good sense for over all property use and is an excellent tool in addition to current zoning. It would help make good use of certain parcels by providing a good mix of compatible land use types and by retaining the rural and natural character of the township through the preservation of open spaces, woodlands, streams, water frontage, hills and similar assets. Motion support came from Chattaway. Roll call vote: Beckley, absent; shepherd, yes; Van Berlo, yes; Johnson, yes; Chattaway, yes. Motion carried. Discuss content of MTA zoning seminar attended on July 24, 2007: Bill Dohm asked the Board how they felt we were doing as a Township with our Zoning.
They felt the corridors in the Township have been built up as had been expected but we are maintaining the rural character of our area.
The Board felt the seminar stressed the “be legal” fact and most important is to document everything you do- if it is in the minutes it is binding.
Bill Dohm felt the future land use most important and when the master Plan is opened we need to go through it one parcel at a time to see how to maintain our rural atmosphere. He felt it might be a better idea to wait for the census data to be released before opening the master Plan and asked the Board to consider what they would like to see done in the future with the possible excess property owned by the Sewer Authority.
Open Discussion for issues not on the agenda:a. Correspondence received. The Board received the current copy of the Planning Commissions Journal and the Zoning Bulletin.b. Zoning Board Members. Joe Chattaway asked if anyone had seen the article on Zoning Ordinance Amendments needing an impact statement. Bill Dohm felt it was just another ploy to make things difficult for Townships.
Mr. Dohm noted the zoning cases are much lighter and asked the Board if they would want to consider work sessions during the regular scheduled meetings. The Board was totally in favor of this.c. Public Comment.There was no public comment. Adjourn:
