LITTLE TRAVERSE TOWNSHIP ZONING BOARD OCTOBER 8, 2007 7:30 P.M. TOWNSHIP HALL The meeting was called to order by Chairman Joe Chattaway.

Also present were Randy Frykberg , Bill Dohm, Jane Taylor, Brentt Michalek and Christina Rohm ( Petoskey News).
Minutes:
A motion to approve the minutes with one typo correction ( spelling of developments in the second line under “Receive and discuss amended Airport Approach Plan for the H.S. Airport”) was offered by Beckley and supported by Johnson. Approved by voice vote.
Approve agenda:
There were no objections to the agenda as presented.
Case #B-9-2007:
Review proposals and procedures to adopt an amendment to address sexually oriented
Businesses, ( SOB).
Randy Frykberg reviewed the Memo given to the Board at the September meeting.
Brentt Michalek, Director of Emmet County Planning and Zoning and Ordinance Enforcement, spoke to the Board about the issues the County has dealt with in dealing with the SOB south of Petoskey and the County’s recently adopted SOB Ordinance. The points he stressed were negative secondary effects, you can not assign any subjectivity, time limits are excluded for SOB’s and everything revolves around the First Amendment, protection of free speech. He said to be sure you have adequate land available and we need to be aware of the Legislative History regarding SOB’s. Mr. Michalek noted that we do not have a definition of “Residential” is not included in our current zoning ordinance. He said he had talked with Kathy Abbott about our SOB considerations and she strongly advised the Township get strong legal advice for the SOB Ordinance.
Bill Dohm said he would not be opposed to a joint venture with surrounding townships for this Ordinance if this could be allowed. He would check into this further. The discussion was exploratory and no action was taken.
